"COORDINATION" AND "COOPERATION": CORRELATION OF CATEGORIES IN FINNISH LAW

Finnish legislation confuses the concepts of “coordination” and “cooperation”. In this regard, the interest is Act on Public Contracts (348/2007). 

The act created for some coordination purposes: this Act governs the entry into force of Directive 2004/18/EC of the European Parliament and of the Council on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts, hereinafter referred to as the "Directive on public contracts", and Council Directive 89/665/EEC on the coordination of the laws, regulations and administrative provisions relating to the application of review procedures to the award of public supply and public works contracts, hereinafter referred to as the "Directive on the review procedures" [1]. However, it describes the mechanisms of cooperation. 

Another example: in Act on Cooperation on Client Services within Rehabilitation Adopted in Helsinki on 13 June 2003 [2] first talked about the collaboration: (1) Social welfare and health care authorities, employment and educational authorities and the Social Insurance Institution shall cooperate with each other at the local, regional and national level. These authorities shall also cooperate with other organisations organising rehabilitation (Section 2 «Forms of cooperation»). 

Then in the same terminology we are talking about coordination: (2) Cooperation on client services is primarily carried out as a part of the usual activities of the relevant authorities. Furthermore, cooperation is carried out in local, regional and national cooperation bodies. Provisions on those bodies are laid down below (Section 2 «Forms of cooperation»). 

In the definitions as stated on cooperation and coordination: 2) cooperation on client services means activities that involve agreeing on the principles and procedures for the mutual cooperation of authorities and serviceproviders and seeking solutions to satisfy the rehabilitees’ rehabilitations needs (Section 3 «Definitions (1) For the purposes of this Act»).

In tasks the purpose of the activity is defined rather as coordination: (1) The task of the cooperation group for client services within rehabilitation is to develop the forms of cooperation between the authorities, other organisations and institutions referred to in this Act, agree on the principles and procedures for the mutual cooperation of authorities and service providers, manage the exchange of information necessary for the cooperation and deal 3 with other joint matters regarding the organisation of rehabilitation. The cooperation group plans, promotes and monitors the rehabilitation of clients (Section 7 «Tasks of the cooperation group»). 

Thus, the analysis of the legislation indicates a great Convention and variability in the use of terms. The same term in the same act referred to as cooperation and coordination.
