Nowadays the world is witnessing formation and development of a new loop of civilization in a historic context. However, the sustainable development of society is increasingly constrained by global problems.

Many kinds of organizations, as well as governments worldwide use legislation as a practical tool to implement environmental policy. Specific legal rules with transparent, effective mechanism can and have to play an important role to provide eco-freindly sustainable production and consumption practice globally, regionally and locally according to environmental policy. Dramatic consequences of global ecological problems cannot be stopped without making a shift to implement specific practical tools, as public procurement may be by playing an important role to provide sustainable production and consumption practice globally, regionally and locally. Most of developing countries have powerful state mechanism of legal regulations. Therefore, this peculiarity has to be applied in positive way.

Procurement process in developing countries can be used as a practical tool of ecological policy governance in three main ways, which are:

1) to keep up the role of regulator of world and national economies, stimulus to direct market and industry with the purpose of ecological policy governance;

2) to determine the national or regional concept aimed at managing ecological situation;

3) to provide state internal functions concerning providing goods, works and services, which do not have negative impact to environment in the world.

Main preferences of using public procurement as a practical tool of environmental policy are:

- Procurement process includes all type of state institutions, public organizations, business companies as well as individual person or target group of citizens;

- Public procurement is one of the key area, where the public sector and the private sector interact closely, mainly financially. Worldwide, procurement spending averages between 13 per cent and 20 per cent of gross domestic product.  Every year an estimated average of US$9.5 trillion of public money is spent by governments t1hrough public procurement ;

- Public procurement is a purposeful mechanism of a state to carry out it’s interior (e.g. provide sustainable goods and services) and exterior (e.g. implement international economic strategies) functions;

- Legislation on public procurement contains specific references to the possibility of including environmental considerations (e.g. Directives, adopted by Council and the European Parliament, governing procurement: Directive 2004/18/EC, Directive 2004/17/EC).

This idea has to be carried out deliberately, gradually and applying general and specific scientific methods.

І. Thus, on the first stage using methods of comparative analysis and synthesis will be appropriate in order to clarify the legislative regulation level concerning ecological policy and the functioning of public procurement in developing countries.

ІІ. The next stage should be devoted to the disclosing all existing problems and obstacles, which, in particular, are: lack of negative consequences understanding of ecological problems in developing countries; inadequate environmental legislation of developing countries; corruption in public procurement. 

ІІІ. Using system-structured scientific method on the third stage, it is possible to make fluent implementation of main rules and regulations adopted in existing European Directives to national legislation systems of developing countries. 

ІV. On the final step, method of objective observation globally, regionally and locally may help to focus on effectiveness of public procurement management to apply corrective actions.
