COORDINATION RULES OF RIGHTS IN CURRENT LEGISLATION OF GIBRALTAR

In the current Gibraltar legislation, coordination rules are widespread.

For example, paragraph 1 of Article 5 FINANCIAL SERVICES (CAPITAL REQUIREMENTS DIRECTIVE IV) (ENFORCEMENT) REGULATIONS 2016 [1] states that it is necessary to coordinate your actions with other authorities when considering cross-border trade cases.

By virtue of paragraph 6 of Article 4 ENVIRONMENT (DEPLOYMENT OF ALTERNATIVE FUELS INFRASTRUCTURE) REGULATIONS 2016 [2], where necessary, the government shall cooperate through consultations or a joint policy framework to ensure that the measures necessary to achieve the objectives of this Regulation are consistent and coordinated.

Based on paragraph 6 of PORT RULE (ENHANCING SECURITY) RULES 2008 [3], the port authority must ensure that the port security measures introduced in this Regulation are closely coordinated with those adopted in accordance with the EU Regulation.

In accordance with paragraph 8 of article 9 of the same act, monitoring must be coordinated with other control activities carried out in the port.

According to paragraph 2 of regulation 8 of this act, it is important to ensure coordination between security measures for areas with different security characteristics; the integration with other response plans and / or the inclusion of specific responses, procedures and actions should be strengthened. The plan will detail interaction and coordination with other emergency response and resolution plans. Conflicts and other lack of coordination will be resolved where necessary; working port security arrangements and operating procedures require coordination.

As follows from paragraph 2 of regulation 9 of the said act, various types of exercises, which may include the participation of the port facility security personnel in conjunction with the relevant authorities, security personnel or ship security officers, if any, will be conducted at least once every calendar year no more than 18 months between training exercises. Requests for the participation of security personnel or security officers in joint exercises will be conducted taking into account the safety and impact on the ship's operations. These training exercises will test communication, coordination, resource availability and responsiveness.

Thus, in the current legislation of Gibraltar, coordination rules of law are quite widespread.

In our opinion, among the shortcomings of these norms, one can note the low quality of their structures and fragmentation. Very often these are norms of indirect action: they themselves do not essentially resolve this or that actual life situation, but only refer to other, as a rule, of a different quality, legal norms that do not have a coordinating character.
