COORDINATION IN THE PUBLIC SERVICE SYSTEM OF THE REPUBLIC OF ESTONIA

The coordination mechanism is actively used in the civil service system of the Republic of Estonia [1; 112]. As provided in § 63. “Salary guide” Civil Service Act (Passed 13.06.2012 RT I, 06.07.2012, 1 Entry into force 01.04.2013, §§ 108-110 and 136 entered into force 16.07.2012) [2] “(4) The Minister and the Secretary of State shall establish, in accordance with the provisions referred to in paragraph 10 (1) of Article 5 of this Law and are coordinated with the Ministry of Finance, respectively, the salary guidelines for the Ministry and the Government Office and the government body of the Ministry in the area. The Salary Manual of the Office for Gender Equality and Equal Treatment is administered by the Gender Equality and Equality Commissioner in coordination with the Ministry of Finance. ”

In § 108. "Implementation of §§ 7 and 63 of this Act" it is determined that "(2) The Minister in charge of the district shall establish by regulation a timetable for the authorities in order to represent and agree on the composition of personnel and the management of the salaries of the authorities. The scheduling takes into account the amount of authority and staffing required, and the time spent on training and coordination. [RT I, 29.06.2014, 109 - entry into force 01.07.2014, on the basis of subsection 107 (4) of the Government of the Republic Act the words "Minister of Finance" have been replaced with the words "minister responsible for the area ”from 1 July 2014.]

In clause 3, it is indicated that the Ministry of Finance reviews the composition of the personnel and the salary guidelines specified in part 1 of this article within two months from the date of submission of the composition of the personnel and the salary guidelines and approves or refuses to approve it for a valid reason. Clause 4 specifies that the new staffing and salary guidelines agreed with the Ministry of Finance will enter into force simultaneously with the Civil Service Act. Clause 8 stipulates that the Ministry is not required to submit personnel information and salary guidelines for security agencies to the Ministry of Finance for coordination. However, coordination is also observed in the legal regulation of the labor market. As follows from § 21. "European Works Council Agreement" Community-scale Involvement of Employees Act (RT I 2007, 22, 112 - entry into force 23.03.2007; Passed 12.01.2005 RT I 2005, 6, 21 Entry into force 11.02 .2005) [3] “The agreement between the special negotiating body and the central management on the establishment of the European Labor Council must be in writing and must contain at least the following conditions: coordination of the information and consultation procedure with the European Works Council with the representative body of Estonian workers, taking into account their competence and activities, as well as that information and consultation take place at an appropriate level and cover issues of a transnational nature.
