MEDICAL LAW AS A MODERN TOOL FOR PROTECTION HUMAN RIGHTS

According to the Constitution of Ukraine, everyone shall have the right to health protection, medical care and medical insurance. The State shall create conditions for effective medical service accessible to all citizens. Unfortunately, formal provisions and real situation are not the same. Our medical equipment are outworn, hospitals are overcrowded, money and connections can resolve any problem. Ukrainian government aimed to start global medical reform, allowing to satisfy the human needs. In such situation the great attention is paid to medical law with his gaps and collisions.

Question of health care reforming were considered in many works including such scientists as Z. Gladun, R. Grevtsova, D. Karamyshev, O. Musiy, V. Pashkov.

There are many laws in medical area: «The Fundamentals of the Ukrainian legislation on health care», «On ensuring sanitary and epidemiological welfare of the population», «On protection of the population against infectious diseases»,  "On the fight against tuberculosis", "On psychiatric care", "On Medicines", etc.

The origin of medical law relates to 2008, when All-Ukrainian public organization “Foundation of medical law and bioethics of Ukraine” was founded. The main aim of the Foundation’s activity is the promotion of development of medical law as a branch of law.

I.M. Alekseeva considers that medical law is a «set of regulations that determine the organizational, structural, common law relationship in the provision of preventive and curative care for people carrying out sanitary and anti-epidemic measures and other actions related to health activities».

M.A. Anischenko claims that all patients in Ukraine in accordance with the Lisabon Declaration of the World Medical Association have the such rights in health care like as the right to dignity and self-respect; the right to self-determination; the right to freedom of choice; the right to information; the right to privacy and others.

But, on the other hand, professor. S. G Stetsenko compares medical rights, declarated in Basic Laws of Ukraine on Health Care and their practical implementation. He claims, that the patients’ right to choose the doctor and the hospitals, unfortunately, is not fully implemented in our country. The patients, which have the material opportunity to choose the medical staff are in more beneficial situation than others. And it worth to say that there is a lack of a clear system to inform patients about the institutions where you can get a particular medical assistance as well as training professionals who provide it. 

In our opinion there are lead factors, proving the importance of this law:

- consists of rules, that provide the opportunity to protect the violated rights;

- regulates the relations in specific social sphere;

- indicates the possibility of receiving medical care in a medical institution with the best modern equipment;

- provides getting medical services in time, in fixed way, with the usage of modern equipment.

We can conclude, that medical law provides an opportunity to use the services of lawyers, legal representatives at all stages of treatment, ranging from the need for hospitalization, including treatment prescribed, and ending with the need to defend the rights and legitimate interests of patients in the trial.
