[Section 2. Constitutional law. Constitutional judicial law. International law]

Author: Maksurov Alexey Anatolevich, PhD in Law, Professor, Kiev National University named after Taras Shevchenko

The coordination acts of the United Kingdom on cooperation in the field of security in the cyber environment are quite interesting and numerous [1, 159].

Among the most significant acts, the Law on the Misuse of Computer Technologies of 1990 should be highlighted [2]. This act provides for criminal legal measures in the field of combating cybercrime. In addition to the issues expected for such a law, the formulation of signs of a crime, the establishment of criminal sanctions, etc., the Law also contains important fundamental provisions.

Another act is the Data Protection Act of 1998 (the Data Protection Act of 1998) [3] This act resolves issues of criminal liability for illegal disclosure of personal data, including using computer technologies. It should be noted that under this act, criminal liability arises for the illegal disclosure of personal data if these actions caused or could cause significant harm to the person whose personal data was disclosed, or caused significant harm to his rights and freedoms.

In order to combat spam (unwanted computer information) in the UK, the Privacy and Electronic Communications (EC Directive) Regulations 2003 (Regulation on Private Information and Electronic Communications 2003) was adopted in 2003 [4]. This Provision builds an interesting scheme of protection of rights: companies are required to obtain the permission of an individual before sending him messages by e-mail or SMS (the provisions of the law also apply to phone calls and faxes).

Further improvement and clarification of the issues of bringing to justice for violations in cyberspace was made in The Police and Justice Act of 2006 [5]. In fact, this law significantly changes the provisions of the current "basic" Law on the Misuse of Computer Technologies.

So, according to the act, the maximum term of imprisonment for certain cyber violations, etc. has been increased. However, some definitions have also been changed (in the direction of expansion, taking into account the requirements of the time and novelties in the Internet architecture itself), for example, the wording "unauthorized modification of computer materials" has been changed to "unauthorized actions that intentionally or inadvertently interfere with the normal operation of a computer, etc.". In general, this act reflects the current state of affairs in the field of combating cybercrime.

Thus, we believe that within the framework of the above acts, the necessary legal framework has been created in the UK for coordinating the activities of authorities and, first of all, law enforcement and regulatory authorities in the field of combating cybercrime and cybercrime offenses. The experience of multifactorial regulation could well be perceived by other countries.
